New Jersey Failure to Stop & Red Light Traffic Tickets

A conviction or guilty plea for running a red light may result in a 15 day jail term, a $200 fine, New Jersey DMV points, and car insurance points.

These are serious consequences. If the driver, at the time the traffic ticket was issued or later, has other violations, the multiple offenses can result in even harsher penalties. Our lawyers take every charge against our clients seriously. If you would like to discuss defense of a ticket for running a red light or stop sign, failure to yield, or any other traffic violation with one of our attorneys, please contact our office and arrange a free consultation.
Defense of failure to stop for a red light or stop sign
Was the traffic light defective? Was the stop sign visible behind overgrown foliage? Was the arresting officer in a position to accurately calculate the distance you stopped before the intersection? When crafting a defense of a traffic offense, our lawyers consider all of the facts surrounding the charges against our client. Other unique aspects of the case may come into play, including prior offenses which will affect sentencing, and our client's personal goals. Our attorneys are prepared to handle cases involving a variety of traffic violations:
  • Failure to observe a stop sign
  • Failure to observe a traffic signal
  • Failure to stop for a police whistle
  • Failure to yield at an intersection
  • Failure to yield right of way
  • Failure to keep to the right
  • Failure to pass on the left
If you have been charged with running a red light or another traffic violation, you can only make a well-informed decision about how to proceed after discussing your case with an attorney with the appropriate experience. If you would like to speak with a traffic lawyer from our firm, call or e-mail to arrange a free consultation.

Our mission is to keep your points and keep your insurance cheaper

Our Firm boasts a 99-percent success rate at reducing or keeping points off our clients' driving records, whether they're guilty or not. The key, is a savvy staff that screens cases and knows where preparation time is best spent. We know the steps required to beat your NJ traffic ticket!

Like most traffic attorneys in NJ, our Firm has no interest whatsoever in whether you're innocent or guilty. For a traffic attorney, it is far more important to know who ticketed you and where. That determines the court in which your case will be called and the result we are capable of ascertaining.
In the smaller jurisdictions, most of their officers appear when you set a case for trial and we have to work extra hard to achieve the results we boast. In larger cities, it is much more likely that the case will be dismissed or the officer won't show up.

Each county is different; for some counties, mistakes don't matter to them -- if you've got a ticket, you've got to deal with it.

In our Firm, we do not spend a lot of time arguing whether or not our clients are guilty. Instead, if there are not triable issues, our Firm works with the judge and prosecutor in a friendly adversarial manner to determine and ascertain the best results for your traffic ticket.
Our New Jersey Traffic lawyers know the players, the economic directives, the ever-changing laws and the processes by which cases get resolved in the local traffic courts. A case may be dismissed outright if the issuing officer doesn't show up as complaining witness. Or it may be bargained into dismissal in exchange for pleas on other nonmoving violations. Or they may be dismissed after an unsupervised probationary period, but you'll have to pay all or part of the fine.
The point is, even if you end up paying a fine, your case won't be recorded. This means, no points on your license, and cheaper insurance premiums.

Your license was suspended in New Jersey?

Have you been charged with driving while your license was suspended? The Stabile Law Firm can help you! We have served thousands of clients and won cases by proving the DMV wrong!
Call Us Now For A Free Consultation: 1-877-VIOLATION
Did you know that thousands of vehicles are pulled over in New Jersey and New York and people are surprised to be informed that their license is suspended! The minimum costs for driving while suspended is $1261 in costs, fines, and surcharges.
The violation of Driving While Suspended is set forth at NJSA 39:3-40. This section states, "no person to whom a driver license has been refused or whose driver's license or reciprocity privilege has been suspended or revoked or who has been prohibited from obtaining a driver's license, shall personally operate a motor vehicle during the period of refusal suspension, revocation or prohibition." The statute also prohibits the operation of a motor vehicle whose registration has been revoked.
Penalties For Driving While Suspended (If you are convicted guilty)
The penalties for a first offense is a fine on the amount of $500. In addition to that, the defendant is charged a surcharge of $250/year for 3 years. A second offence holds a fine of $750 and jail time for up to 5 days! A 3rd offence means a $1000 fine plus jail time for 10 days. If the vehicle was in violation and involved in an accident resulting in personal injury, jail time will be at least 45 days.
If an individual violates this section while under suspension issued pursuant to 39:4-50, driving under the influence of liquor or drugs (DUI and DWI) and is convicted, they shall be fined $500.00 extra and have their license suspended for an additional period not less than one year or more than two years and may be in the county jail for not more than 90 days. The defendant will also be surcharged a mandatory $250.00 per year for 3 years.
Although most municipal court hearings are considered minor by many citizens it is obvious from the possible penalties involved that this is a serious offense carrying the possibility of both stiff fines and incarceration.
There are two types of license suspension:
1. Court imposed suspension
2. Administrative / Division of Motor Vehicles suspension
The most common type is when the driver fails to pay a surcharge or accumulated points has been placed on a suspended list maintained by the New Jersey Division of Motor Vehicles (Division of Motor Vehicles). This makes it illegal for the personal to drive a vehicle for a prescribed period of time in this New Jersey.
If you have been pulled over and are aware of your license being suspended and tell that to the trooper, it will be much harder to create a defense for such a case. However, more often than not the driver claims that they were unaware of their placement on the suspension list which is why the Stabile Law Firm has such a high success rate of winning driving while suspended cases. We put the burden of proof on the state!

Our law firm has represented over 100,000 cases for traffic ticket in Woodbridge and other NJ townships, and the majority of those traffic violations were speeding tickets. Speeding tickets are the most common type of traffic tickets given in New Jersey and New York.  However, most of the time, multiple traffic tickets are issued in addition to the speeding ticket. State troopers are known to give speeding tickets even for going 5mph over the speed limit. Generally the faster you speed the more points will be associated to the speeding ticket. New Jersey has four grouped speeding tickets into 3 categories:
2 Point Speeding Tickets
Exceeding maximum speed 1-14 mph over limit
4 Point Speeding Tickets
Exceeding maximum speed 15-29 mph over limit
5 Point Speeding Tickets
Exceeding maximum speed 30 mph or more over limit

Frequently Asked Questions - New Jersey Traffic Tickets

1. Can I really get a free consultation with an attorney at no obligation?

Absolutely! When you call our office and request to speak to an attorney, a traffic ticket attorney will get on the phone with you and give you the best advice based on your current situation.

2. Why shouldn't I just pay the fine?
http://www.njnytraffictickets.com/
In most states, paying the fine means the ticket will be on your record for the next THREE YEARS.  Insurance companies regularly check their customers driving records and can increase insurance premiums based on your driving record.  Accumulating points results in additional fines and even suspension of your license. Some traffic violations in New Jersey are also criminal convictions, that's right, CRIMINAL CONVICTIONS!  They show up on background checks done by prospective employers and can even be used as evidence against you if you are sued as a result of an automobile collision.

3. What about Defensive Driving Courses?

If you have 4 points or more on your driver's record...
Successfully completing this course will dismiss 2 points from your record. The course may be completed once every five (5) years in order to reduce your point total.

Call 877-violation and schedule a class to reduce point associated to your New Jersey Traffic Ticket.

4. Why do I pay the fine if my lawyer is going to fight my ticket?
http://www.njnytraffictickets.com/
When our lawyer appears on your behalf, he or she will bargain with the assistant district attorney or officer of the court to dismiss the ticket, and keep it off your driving record.  This is what you are paying us for. Unless fully dismissed, the fines you are paying at the end are associated to the ticket issued and court fees

5. Does my case go to trial?
http://www.njnytraffictickets.com/
In most situations, your attorney will dispose of your ticket at the arraignment. The date you are ordered to appear on your ticket is called the arraignment date and the purpose of the arraignment is to enter a plea of guilty, not guilty or no contest. If your attorney is not able to negotiate a favorable outcome for you, he or she will contact you to see if you want to go to trial.
